# AveloVPN Terms of Use Last updated: April 29, 2026 These Terms of Use ("Terms") govern access to and use of the AveloVPN website, Telegram bot, software, and related network services (collectively, the "Service"). By registering, activating a trial, placing an order, or using the Service, you agree to these Terms. ## 1. Definitions For purposes of these Terms: - "Site" means the AveloVPN website. - "Bot" means the AveloVPN Telegram bot. - "Seller" means the operator of the Service. - "User" means any individual or legal entity that accesses or uses the Service. - "Buyer" means any individual or legal entity that purchases a paid subscription or other paid access to the Service. - "Subscription" means paid access to the Service for the period and device allocation stated on the Site or in the Bot. - "Trial" means any free or discounted test access made available by the Seller under the conditions published at the time of activation. - "Order" means a request by the Buyer to obtain a Subscription through the Site or Bot. - "Applicable Law" means any law, regulation, regulatory act, court order, or lawful demand applicable to the User, the Buyer, the Seller, or the Service. - "Blocked Resources" means websites, apps, domains, IP addresses, pages, protocols, or other destinations that the Seller blocks or restricts in order to comply with Applicable Law or a lawful demand of a competent authority. ## 2. Nature of the Service 2.1. The Service provides VPN-related software, routing, and network privacy functionality for lawful use only. 2.2. The Service is not intended, offered, or supported for the purpose of accessing information, resources, websites, applications, or services that are prohibited in the User's jurisdiction. 2.3. Where required by Applicable Law, the Seller may restrict or disable access to particular destinations, domains, IP addresses, protocols, applications, or categories of content, including resources included in official blocked-resource registries or equivalent restriction lists. 2.4. For users located in or using the Service from the Russian Federation, the Service may block or limit access to resources that the Seller determines must be restricted under applicable Russian legal requirements, including resources included in Roskomnadzor registries or similar official lists. 2.5. The Seller may change, suspend, limit, or discontinue any feature of the Service at any time where reasonably necessary for security, abuse prevention, operations, or legal compliance. ## 3. Eligibility and Registration 3.1. The User represents that he, she, or it has the legal capacity and authority to accept these Terms. 3.2. When creating an account or placing an Order, the User or Buyer must provide accurate and current information requested by the Seller, which may include a Telegram ID, support contact, or other account identifier. 3.3. The User is responsible for maintaining the confidentiality of account credentials, keys, invitation links, or any other access data issued by the Seller. 3.4. The Seller may refuse registration, activation, or access where the information provided is incomplete, inaccurate, misleading, or presents an elevated legal or abuse risk. ## 4. Orders and Activation 4.1. Orders may be placed through the Site or the Bot, subject to availability. 4.2. After successful payment and verification, the Seller will provision access credentials or activation instructions using the contact method or account identifier associated with the Order. 4.3. Unless otherwise stated on the Site or in the Bot, an Order is considered delivered when the activation data or access instructions are sent to the relevant Telegram ID, account, or other designated delivery channel. 4.4. The Seller is not responsible for delayed or failed delivery caused by inaccurate contact data, failures of third-party messaging platforms, or circumstances outside the Seller's reasonable control. ## 5. Fees and Payment 5.1. Subscription fees, plan descriptions, and available payment methods are published on the Site or in the Bot and may be updated from time to time. 5.2. Payments are processed by third-party payment providers. Payment availability may vary by jurisdiction, currency, and risk controls of the relevant payment provider. 5.3. The Seller does not represent or warrant that any specific payment method is lawful, available, or suitable in every jurisdiction. The Buyer is responsible for ensuring that the chosen payment method may lawfully be used by the Buyer. 5.4. Any taxes, banking fees, network fees, or processor fees applicable to the transaction are the responsibility of the Buyer unless mandatory law provides otherwise. 5.5. If a paid period expires and is not renewed, the Seller may suspend or limit the corresponding Subscription, device allocation, or account features until payment is received. ## 6. Trial and Refunds 6.1. If the Seller offers a Trial, the duration, scope, and eligibility conditions of the Trial will be stated on the Site or in the Bot at the time of activation. Unless otherwise stated, only one Trial may be granted per user, account, or device group. 6.2. Except where mandatory law requires otherwise, paid Subscription fees are generally non-refundable once access credentials have been issued and the Service has been materially used. 6.3. Unless a different refund policy is published on the Site or in the Bot, a Buyer may request a full refund within 14 calendar days after payment if: - the request is made through the Seller's designated support channel; - the paid Service usage after payment did not exceed 50 MB; and - the account has not been suspended or flagged for abuse, fraud, or violation of these Terms. 6.4. Partial refunds are not guaranteed unless required by mandatory law or expressly approved by the Seller. 6.5. Nothing in this Section limits any non-waivable consumer rights that may apply under mandatory law. ## 7. Acceptable Use and Compliance 7.1. The User must use the Service only for lawful purposes and in compliance with Applicable Law. 7.2. The User must not use the Service: - to access, distribute, or facilitate access to content or resources prohibited in the User's jurisdiction; - to distribute malware, ransomware, spyware, phishing content, spam, or other malicious or deceptive materials; - to perform denial-of-service attacks, unauthorized scanning, credential stuffing, password guessing, or other attacks on networks, systems, or accounts; - to impersonate another person or entity, misrepresent identity, or commit fraud; - to infringe intellectual property, privacy, confidentiality, or other rights of third parties; - to resell, sublicense, or share access to the Service in violation of the Seller's published plan terms; or - to engage in any conduct that creates legal, regulatory, reputational, or security risk for the Seller, other users, or third parties. 7.3. Unless expressly allowed by the Seller in writing, P2P and BitTorrent traffic may be blocked, rate-limited, or prohibited on some or all servers. 7.4. The Seller may use reasonable technical and organizational measures to detect abuse, protect the Service, and enforce these Terms. ## 8. Data Processing and Privacy 8.1. The Seller may process limited account, transaction, support, and technical data necessary to operate the Service, secure the network, investigate abuse, respond to support requests, and comply with Applicable Law. 8.2. Such data may include, for example: - Telegram ID or other account identifier; - subscription status and plan metadata; - payment processor references or billing status; - support correspondence; - device or connection-related technical events necessary for operations, abuse prevention, diagnostics, or legal compliance. 8.3. The Service is designed to minimize traffic logging and does not intentionally inspect the content of User communications except where reasonably necessary for security, troubleshooting, abuse prevention, or legal compliance. 8.4. The Seller's Privacy Policy, as updated from time to time, forms part of the legal framework governing the Service. If these Terms conflict with a mandatory rule of applicable data protection law, the mandatory rule prevails. ## 9. Availability and Disclaimers 9.1. The Service is provided on an "as is" and "as available" basis. 9.2. The Seller does not guarantee uninterrupted availability, specific throughput, latency, compatibility with every device, or access to any particular website, app, service, region, or protocol. 9.3. The Seller does not guarantee that the Service is lawful, appropriate, or available for use in every jurisdiction. The User is responsible for determining whether use of the Service is lawful in the User's location and for the User's intended purposes. 9.4. Temporary outages, routing changes, protocol changes, maintenance windows, anti-abuse restrictions, or legal restrictions do not by themselves constitute a breach of these Terms. ## 10. Suspension and Termination 10.1. The Seller may deny, suspend, restrict, or terminate access to the Service immediately, with or without prior notice, if: - the User violates these Terms; - the Seller believes the Service is being used for unlawful or abusive activity; - the Seller determines that continued access would create legal or regulatory risk; - payment is overdue, reversed, charged back, or identified as suspicious; or - continued service becomes technically or legally impracticable. 10.2. The Seller may also disable or modify features, destinations, or protocols on a server-wide or jurisdiction-specific basis where reasonably necessary for compliance, security, or operations. 10.3. Suspension or termination under this Section does not create a right to restoration, compensation, or refund except where mandatory law requires otherwise. ## 11. Limitation of Liability 11.1. To the maximum extent permitted by Applicable Law, the Seller is not liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, data, business opportunity, or goodwill arising from or related to the Service or these Terms. 11.2. To the maximum extent permitted by Applicable Law, the Seller is not liable for: - failures of internet providers, hosting providers, data centers, app stores, messaging platforms, payment processors, or other third parties; - acts or omissions of authorities, regulators, or telecom operators; - restrictions, blocking measures, or service degradations imposed by third parties or by operation of law; or - unlawful acts, negligence, or misuse by the User. 11.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law. ## 12. Indemnity 12.1. The User agrees to indemnify and hold harmless the Seller, its officers, personnel, contractors, and affiliates from third-party claims, losses, damages, liabilities, costs, and expenses arising out of or related to: - the User's violation of these Terms; - the User's unlawful use of the Service; or - the User's violation of rights of any third party. ## 13. Changes to the Terms 13.1. The Seller may update these Terms from time to time. 13.2. The updated version becomes effective upon publication on the Site or in the Bot, unless a later effective date is stated. 13.3. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms. ## 14. Governing Law and Disputes 14.1. The parties will attempt to resolve disputes through good-faith negotiations before starting formal proceedings. 14.2. If a dispute cannot be resolved through negotiations, it will be handled in accordance with the mandatory law applicable to the Seller and, where applicable, mandatory consumer protection law. 14.3. Nothing in these Terms deprives a consumer of any mandatory rights that cannot lawfully be waived. ## 15.
